Dwain Chambers today lost his High Court bid to be allowed to compete at next month’s Olympic Games in Beijing.
Mr Justice Mackay refused to grant an injunction to temporarily suspend a lifetime ban on the sprinter competing at the Olympics.
The ban was imposed by the British Olympic Association (BOA) because of his self-confessed past use of performance-enhancing drugs.
The judge issued his ruling this morning after spending yesterday listening to the conflicting arguments over the athlete’s attempt to win an injunction suspending the bylaw before a full trial of the issues in March next year.
Chambers said he would not appeal the decision.
The verdict could bring about the end of Chambers' athletics career.
“If he does not go to Beijing, he walks into the sunset,” Jonathan Crystal, Chambers' barrister, said yesterday.
The judge returned to the London court this morning to give his ruling to a packed courtroom and the athlete himself.
He said: “Many people both inside and outside sport would see this bylaw as unlawful.
“In my judgment it would take a much better case than the claimant has presented to persuade me to overturn the status quo at this stage and compel his selection for the Games.”
During the hearing yesterday, the judge had commented to Jonathan Crystal, the barrister representing Chambers: “The reality is that you are saying ‘put him on the plane’.”
Crystal had told the judge that banning Chambers could deprive Britain of its best chance of winning a medal in the 100 metres in Beijing next month. Chambers had won the 100 metres at the British Olympic athletics trials in Birmingham on Saturday in 10 seconds.

At the end of the day, he knew what the punishment was when he made the decision to take the drugs so he can't quibble about it now.
Vicki, Plymouth,
How hyocrital! The British Olympic Association allows Christine Ohuruogu, the 400 metres runner who missed three straight mandatory drug tests to compete in the Olympics, but not Dwain Chambers.
Tom, London, England
I don't think Chambers should compete purely because he's so much better, hence no chance for the newbie's.
But, I don't think somebody should be punished for life once they've realized the error of their ways. If the world worked like that, rehabilitation of offenders would be useless.
Jonathan Sklan-Willis, Manchester, England
We can now be smug as we watch the Olympic 100m final, knowing that the British holier than thou attitude is alive and well.
What a crazy system, that no other country is hampered by!
Stephen Marks, Romford, England
Chambers did not introduce drugs to the sport; quite the opposite. He may have made some bad decisions throughout his career but he has already paid for them. Athletics corrupted Dwain Chambers and then athletics have punished him twice for being corrupt. This decision is about money; not justice.
Michael Hannant, Tyne and Wear,
Nail Chambers because when he was caught he atleast came clean.
Do you know how many people use drugs and get away with it.
Cyclists use them because everyone else in the sport does. My teacher told me that 10 years ago and look at the sport now. Same with sprinters.
Be tough on drugs evenly

To Arundel who said "Once you have 'served your time', you are free to return to society on an equal footing ? - NO you're not - should a teacher convicted of child abuse go back to teaching, should an embezzler go back to the bank ?
Chambers knew the rules and he knew the punishment
Brian Hancock, Rugby, UK
At one time Olympic were gentlefolk, no longer more's the pity.
Payment in sport ruined everything
Brian P O Cinneide, eThekwini, Afrika Borwa
Can't he be deported as well?
Sam, Bexhill,
Dwain was not looking for sympathy and he is not a bad example to 'our' youngsters. He was merely seeking an opportunity to recify his failings and for that he deserves praise.
Louis, Canterbury,
Yippeee. You can't just change the law because you feel like it.
James, glasgow,
I suggest that Dwain changes nationality and run for his parents' country. Afterall, it'snot like Team GB will win anything.
Mahela, Tottenham,
I fink they should have let him go innit, he's tryin to be posotif yeah and be a roll model fo tha yunger kidz nowdays.
Pretty Ricky , Stretham, UK innit
Dwain mate change nationality and compete for another country!
steve, London, UK
If you don't want to do the time then don't do the crime.
Chris, Ashford, Middx, England
DC should not have been banned for life.
Once you have 'served your time', you are free to return to society on an equal footing, no?
Arundel, Siouth Coast, UK
It's a great decision. The guy had a clear drug taking history to propel him to the top of the sport, it was not a one off mistake. They know the consequences of being caught and thankfully in this money driven world he has not been able to have his cake and eat it. A result for honest hard workers!
olly, Bordeaux, France
The best sporting news since Nadal won Wimbledon. Drug cheats don't appeal to most sports fans. Good riddance Dwain.
Claire, Dublin,
Rules are rules and a cheat is a cheat, you cannot be more fair.mr chambers knew the risks when he took drugs and now he must face up to it.
sean savage, southport,
Chamber's is the only world class sprinter amongst a bunch of below average ,"over paid, over hyped, under achievers".Now that he is not going, why would anyone bother supporting the GB male sprinters?Really.. what is the point?
ed, london, UK
Chambers should never compet in any sport for the rest of his life, its his own fault , he is a drug cheat
Christine seddon, Leigh , Lancs
oh yeah 2012.....cuz then he will be in his prime honest.
These people need to realise....he made a mistake.....how many other athletes you think do this.....Rio Ferdinand? now he is pride of England Football team. Its a disgrace.
But hey its just my opinion
Shane Statham, stoke, UK
Do cheats prosper?
Yes
Until they are caught
A sad episode all round.
UK athletes in the past denied a place in the team because Chambers was picked.
Now a young family with no comprehension of their fathers errors looking to a problematic future.
Dwain, a hard lesson for you and others.
david, southport,
..and just how much public money has been wasted in getting this cheat away from the Olympics?
David, St Albans, UK
May retire? Good riddance to an awful example for our youngsters! I don't know why any self respecting athlete competed against him! Far better to let him have a 'lone victory' than seem to uphold his credibility after his offence. He brought his problems on himself, why offer him any sympathy?
S. Barraclough, Huddersfield, W. Yorkshire
I agree that Chambers should be left out of this year's Olympics. He needs to learn from his mistakes and stupidity.
I don't see any harm in him competing in 2012 though.
Andrew Clarke, Scunthorpe,
