Broadband companies will have to give customers a true picture of broadband speeds, at the point of sale, when a new code of practice from Ofcom comes into force tomorrow.
Providers covering 95 per cent of the market have signed up to the voluntary code, which is being introduced by the communications regulator after its research indicated that around a quarter of customers cannot receive the speeds they were promised.
James Parker, of Moneysupermarket.com, the comparison website, said: "This code should benefit consumers massively. It means that, where a provider has a number of deals available, customers will be put on the most appropriate one.
"It is well-known that advertised speeds are rarely achievable, and this should stop someone who can only get 3Mb paying for 16Mb."
Ceri Stanaway, of Which?, the consumer group, added: "In a recent survey, when we asked people what frustrated them most about their broadband service, slow or inconsistent broadband speed was their biggest bugbear."
Under the code, providers are required to provide consumers, at the point of sale, with an accurate estimate of the maximum speed their line can support. According to some estimates, only half of those on "8Mb deals", for example, can achieve that speed.
The maximum speed available to a household hinges on a number of factors, including its distance from a telephone exchange – the closer, the better – and the quality of telephone cable.
Providers have repeatedly come under fire from consumer groups for "misleading" advertising of connection speeds. Yesterday, the advertising watchdog upheld complaints against a campaign by Tiscali which touted speeds of "up to 8Mb", with the "insufficiently prominent" qualification that "top speeds vary significantly".
The new code also requires providers to clearly explain "fair usage" policies, which put limits on "unlimited download" deals.
Broadband companies that have signed up to the code include AOL, O2, Orange, Sky, TalkTalk, Tiscali and Virgin Media.
Mr Parker said that customers already on broadband deals – with any provider – should ask the company for a free speed check, and should request to be put onto a more suitable deal if their speed is falling far short of the advertised maximum.

I live in the countrywide about 6 miles from my telephone exchange and can only achieve on average 750kbs on broadband but I do get to 1Mb for part of the day (like now). So you lucky people who achieve 3Mbs or more stop moaning!

I signed up to Virgin. Their engineers came, and simply left the wire from my hose to the street connection trailing across my front garden! When they left, I was unable to get a connection, in spite of an hour on the phone to Virgin. Reverted back to BT the next day!

Virtually all websites that you download from will not be able to match Virgin's download speeds, 8Mbps is VERY good. If you want 20Mbps downloads then you have to subscribe to websites that offer download services that quick. BT's service will not improve a website's ability to deliver quicker.

I had enough with the "so called" 8meg package from BT, as I was only getting about 3.5meg most of the time for £16/month. I left BT and went to O2, 8meg for £7.50/mth, I normally receive 6-7meg but has been as high as 12meg. All call centres are in Scotland, they are friendly and cheap. GO with O2!

I'm on Virgin Media 20meg service and getting downloads similar to if i we're signed to an 8mb service. As you can guess all call centres are placed in the far east where none of the conversation makes a difference to your conenction. Never go with virgin...wait for fibre optic BT or similar

It's about time bt broadband came under the same scrutiny as water companies and fined for poor performance I have had trouble with bt broadband for 5 years paying for a service i'm not getting I'm regularly cut off for days on end.the attitude of bt in this country is absymal,reason no competition

Why not (and not just for broadband) require the seller to list the MINIMUM guaranteed?
That would make it much easier for trading standards and the consumer.

William: It is impossible for your ADSL exchange to be in Kent when you live in Fife. An ADSL signal cannot travel the length of the UK, it is designed for very short distances from exchange to user. That is why many people don't get great speeds, becasue they are too far from local exchange.

Yep! I pay for the NT Broadband package "up to 8Mb" but it varies from 400kbs to 2.5Mbs and is constantly changing. I could give some of mine over to BT Fon but who would strip themselves of some of so little? If I got what I pay for then BT Fon would be worth the trouble and get me some money back.

Broadband internet services are sold on a contended basis where on a line the total available bandwidth is shared between users, so if an 8 Mbs service can be shared between anything up to 50 users for domestic services there are services with 20 ,10 & 1 users but the cost is very much higher

Yes I'm with talktalk and live in fife scotland, theres only one telephone exchange in Glasgow and where am I linked to.. Maidenhead in Kent. I should not complain because my broadband if free. I get on avarage 3.5Mbps.
